    Default Backing Up into a Car

    My question involves insurance law for the state of: Illinois

    I was at a light at in the left lane at night waiting to go straight when I noticed my turn was to the left of me. I looking in my rearview mirror and didn't see anyone so I proceeded to back up a bit, like 5 feet to get some room to make the turn to the middle lane when I hit the car behind me. Apparently they were in the wrong lane as well and were trying to switch over to the right lane because they were sideways in half of each lane. Due to their positioning I ended up hitting them on the back door, on the side of the car. I couldn't see them because their lights were not facing my way. I realize I shouldn't have been backing up, but I'm just curious who is at fault here. Thanks.

    It sounds like you but that will be up to the ins. cos. to determine.
