Lease Option Problems

My question involves real estate located in the State of: Kentucky

I have a lease option contract with a home builder in KY, i have come to learn that 5 questions in the disclosure are incorrect. there is a major re-occurring soil issue, the property needs to be regraded, and the builder has admitted to both Realtors, and myself, i also have this in writing, i have asked for a refund of the earnest money i was denied, their was a clause that i looked over that says it i don't close for any reason i will forfeit my deposit. Can they do this? also at the time of the contract being signed i was a FL resident, and i still am. any help would be greatly appreciated!

Run the contract past a local real estate lawyer and get an opinion as to whether the errors are of sufficient magnitude that they may allow you to escape the contract. Are we to guess that the builder has offered to remedy all of these errors at no additional cost?

this has been going on since march last abotu 2 weeks ago is when i finally got fed up, i doubt they will fix a thing
