    Default Foreclosure by a Third Party on Someone Against Whom I Have a Judgment

    My question involves a foreclosure in the State of: New Jersey

    I received a summons listing me as a co-defendant on a foreclosure action.

    I have no link to the property and mortgage in question. The only connection is that years ago I obtained a judgment on an unrelated matter against the person who is the debtor for the mortgage in the foreclosure in question (several other persons are also listed as they have judgments against the debtor).

    What do I have to do to put it on record that I have nothing to do with the foreclosure? Is a letter to the court, copied to the lender's attorney enough? If so what are the key points I should put in?

    You have a lien. They added you in order to (if necessary) extinguish your lien. If you wish to voluntarily give up any claims in order to be released from the action, contact the plaintiff's lawyer and see what they would need you to do.
