Default Possible Vaccine Injury to a Child

My question involves injury or loss that occurred in the state of: Michigan

Our son began to have seizures and other medical issues 5 hours after his 5 month immunizations. He has had a full work up and nothing has showed up for genetic disorders. We believe our son has been damaged by the vaccines. His neurologist has commented before that our son may have had some issues before the vaccines but that the immunizations actually made him worse. A genetics doctor has also commented that because we have found no diagnosis that our sweet boy may have had an adverse reaction to the vaccinations. It has been four years now and our son continues to suffer from frequent seizures and is developmentally a newborn. He is far from being a normal four year old. Can we file a lawsuit?

    On what grounds?

It's highly unlikely that your child's vaccinations are the root of the problem.

Studies conducted by the American Epilepsy Society and the Centers for Disease Control (among other organizations) have shown that while the risk of transient (occurring in the 2 - 14 days immediately following vaccination) febrile seizures after administration of DPT and MMR vaccinations is slightly higher, there is no correlation between vaccination and permanent disorders.

Research conducted by the Epilepsy Research Centre at the University of Melbourne suggests a mutation in a sodium channel gene.

I would suggest you get an opinion from another neurologist before considering looking for a lawyer.

It's really tough to file a defective products lawsuit in Michigan for any medication that has FDA approval. You can discuss your case with a lawyer and, if you believe the cause of the injury can be substantiated as a vaccine, you may also explore the alternate possibility of the National Vaccine Injury Compensation Program.

You should be able to get a copy of the vaccinations used by the physician who issued it. They all have lot numbers attached to it. You may need these numbers to see if there were any "bad lots" that were pulled.

The other problem is that consents were signed prior to the administration of any of them. You should have been informed that vaccines are actually strains/forms of exactly the thing it's protecting you from. It's very rare for this to happen and not largely associated with seizures.

You should check out the Naitonal Vaccine Injury Compensation Program.

You can also file a reaction with the VEARS (Vaccine Adverse Event Reporting System)
