    Default Party to a Class Action Lawsuit

    Hi. Back in 2004 I gave J.K. Harris $3,400.00 to handle my case with the IRS of which I owed and now thanks to J.K. Harris still owe, thousands of dollars. Anyhow, back last summer I got a letter in the mail from some company wanting to know if I wanted to join in a lawsuit against J.K. Harris. I guess they (J.K. Harris) have took alot of peoples money and never did anything for their cases. Anyhow, the letter stated if I wanted to join in the lawsuit to sign my name and send back the letter. At the time I didn't want to do that because I thought that J.K. Harris was still going to get everything taken care of for me. A few months later, to my surprise, I got a letter from J.K. Harris stating that they had dropped my case because I had joined in the lawsuit against them. I still have every paper they ever sent me, along with my receipt for how much I paid them. I also still have the paper from the company who was wanting me to join the lawsuit. Can someone please tell me what I should and could do about them taking my money and not fullfilling their part of the deal? Any help would be so greatly appreciated. Thank you

    As I see it, you can (a) try to see if you can still join the class action (or if you were accidentally added despite opting out), (b) let convince J.K. Harris that you did not join the class action and thus that they should continue working with you, or (c) sue them yourself.

    so, i have the exact same story as you do. I signed up with JK harris in 2003 and all. paid $3500.00 and got nothing from them. i did sign up with the lawsuit. and have heard nothing. i have all of the paperwork. so the website is gone. and the phone number is disconnected. i have read that the suit went in favor of us. so what is my next step in getting what i have coming to me, if anything?

    I, too, have this problem. We contracted with JK Harris in May, 2007. We are still trying to get help. Our representative has been changed three times and we do not get any feedback from them at all. I have sent all the items they have asked for several times. This is the third time this year that I have had to copy all my receipts for expenses, my tax returns, etc. They want the same things every 3 or 4 months. It takes a lot of time and trouble to do this. I was just on line to check to see if to see if there were any class action suits that I could join and came upon this forum. Does anyone have any suggestions? I really don't know what to do!

    Unless you are a NAMED PLAINTIFF at the beginning of the civil action, you will get very little. Members of a class action always get screwed unless they are a named plaintiff or the lawyers. If you think you going to get back thousands in a class action, you are sadly deluded. You would be lucky to get back a couple of hundred.

    Your only real option is to sue them individually. You can sue them locally and for the amounts mentioned, you could probably do it in small claims court. They have had enough of a presence in your state for the court to exercise long arm jurisdiction.
