Almost three years ago, I let a friend of mine pay a bill on my credit card. At the time, there was a zero balance, and we agreed that she would pay of the entire amount. At one point her name was even on the card as a user. To this day she has made minimum payments. Last year we parted ways (roommates), and she said that she would take the furniture and pay for it - which too was on a credit card. Again, she made minimum payments.
Now, I have asked her over and over again when she is going to pay these accounts off. There is never a real solid answer. Now, I am receiving calls that the accounts are not being paid.
She is planning on leaving town soon. I know I could probably get the furniture back - but she was the one that said that she would pay for it. I don’t want it.
My question is, I am thinking about taking her to small claims court. The total amount she owes me is about 2500. I can show that she has made payments in the past on these accounts. If this good enough to prove that there indeed was a verbal contract?
