    Default On Birth Certificate but Never Signed Declaration of Paternity

    my fiance had a relationship with a girl that got pregnant. she was with him and a few other guys during this time. when the baby was born she put his name on the birth certificate and he never signed any declaration of paternity forms. how is this possible? i live in california and i find it hard to believe that a woman can do this without any paternity or acknowledgement from the alleged father.

    How do you know his name is on the birth certificate? If it is, then he must have signed the Declaration of Paternity.

    Or, did she open a case for child support and named him as father, so you're assuming his name is on the birth certificate?

    His name is on the birth certificate and he didn't not sign anything because he was at work the night of the birth and I was also there.at his work when he got the call. She is trying for child support but i don't understand if there may be others how can it be pinned on one particular guy? How does the state simply assume just by the word of the woman? If it is his child he has no problem taking care of it, it's just confusing how this happened. Being a woman i understand where this woman is coming from but if there are others the whole idea of sticking it to one guy baffles me. This whole thing is stressing us out and we are totally lost on what to do.

    The State of California will not allow a mother to name the father on the birth certifiate if they are not married. He would have had to sign an Acknowledgement of Paternity and Declaration of Paternity to amend the birth certificate to add his name. Let the court order a dna test. If it proves he is not the father he will be able to ask the court to have his named removed (provided it is on there and the document is not forged.)

    He can also request certified copies of all documents from the State to ensure they were not forged.

    I think OP is assuming that his name is on the BC because the mom has named him as father in the support case.

    OP, quit freaking out, and make sure he answers any summons or notice of hearing, either from the court or from the CSE. Otherwise, he will be the presumed father and will be ordered to pay child support. As distressedmom said, he will be able to challenge paternity and request the DNA test at the hearing.
