Birth Certificate Concerning Paternity
My question involves paternity law for the State of: Washington
Here is the situation. I was recently with this girl that was separated from her husband. Me and her got together and she got pregnant. Now she has the baby but she is back with her husband right now. I have recently gotten a paternity test done but he signed the paper work as the baby for being his when she left the hospital. I know she had ten days to get things changed over before the birth certificate was changed over but she didn't do the paper work. I got told there isn't much that I can do and if there is what can I? Any kind of help would work out right now.

Well, the husband is the presumed father when the woman is married at the time of birth. You need an attorney.

After you sue, and prove that you're the father, and if too much time hasn't already passed for you to protest.

Re: Birth Certificate Concerning Paternity
You could perhaps file a paternity action. You might need to do genetic testing to prove you are the father. Along with custody you will be liable for support. If you think its your child and you want to be in his/her life then fight for it. Presumed father doesn't mean squat, dna tests are pretty accurate predictors of paternity.

Re: Birth Certificate Concerning Paternity
Ok, here is another issue that I am looking at. If the paternity tests come back saying positive for me, can her husband get me for that? She told me she was sperated and getting a divorce and now she is suddenly back with him.

Not legally, but you might want to watch your back.
