My question involves a traffic accident in the State of: Maine
Recently my vehicle was parked on a quiet side street approximately 3 feet down from someone's driveway. I was still in the car taking my child out of her carseat. The person backed out of their driveway, driver admits to watching out for kids across the street and didn't see me parked. He bumped into my drivers side brake light and scraped up the paint on my rear bumper. The cop said less than $1000 and didn't write a report.
My husband brought the car to our claims adjuster and he wrote out a check for $380 which is minus our $500 deductible and said that we should get that after they get the money from the other person's insurance.......it seems to me that it wasn't my fault he backed into me and why should I have to front the money to fix my vehicle? Should I cash the check or wait until this is resolved....is this standard operating procedure or should I be hearing from this man's insurance company as well?
