Default Last name on a Birth Certificate
I live in NJ and I was told that if my boyfriend and I aren't married, our baby can not have his last name. Is that true?

Default Certificate of Parentage
You should be able to give the baby any surname you want, as long as your purpose isn't fraudulent - yours, his, or an entirely different name. If you want the father identified on the birth certificate, and he does not wish to dispute paternity, you and he can complete a certificate of parentage at the hospital after the baby is born.
