Default Removing Father from Birth Certificate
My question involves paternity law for the State of: Louisiana and Kentucky

My ex-husband and I were recently divorced. Years ago I got pregnant from another man while we were married. We choose to stay together, knowing there was the possibility she was not his. His name is on the birth certificate. The paternity test was a part of the divorce and the divorce papers state that from the test he was found to not be the father and has no legal right or responsibility to her. So how do I go about having his name removed from her birth certificate now? He currently resides in Kentucky, I moved to Louisiana 2 months ago and she was born in Kentucky.

You need to track down the bio father and then file to establish paternity. Once paternity of another father has been established the BC can be amended.

I know exactly where the bio father is, and he does know she exist but chose a long time ago to not be a part of her life. Is there anyway to have the non-bio removed from it without establishing paternity from the bio father?

I don't believe there is, but get a consult with a local attorney to be sure.
