    Default Co-Owners of a Unit Simultaneously Serving on a Board

    My question involves a condominium located in the State of: Florida

    Hello,

    I read in a newspaper article back on June 15th, 2008 that a new law is to go into effect on October 1, 2008 in regards to "co-owners" of an individual unit may not simultaneously serve on a board.

    I was wondering if anyone new where I could get ahold of the actual verbage of the law and the article number?

    The association of my residence currently has a husband and wife, who only own one unit in the condominium, serving at the same time right now and I feel it to be unfair and unjust as they currently hold two votes for one unit.

    Any help you could provide would be greatly appreciated.

    I believe you are referencing this legislation - Ch. 2008-28 (CS/HB 995) Community Associations (PDF).

    Are you sure that's what you read?

    The new chapter 718.303(3) F.S. dealing with condominiums states that fining committee members cannot be board members or persons residing in a board member's household. It says nothing about serving on the Board together.

    I'm not sure if you can access this yet on the internet as it is relatively new. I would go on the internet and plug in "Chapter 718.303(3) Florida statutes" and it should come up. Chapter 718 deals with condos. Another chapter entirely deals with homeowner associations.
