    Default Court Sells Old Eviction Form, Eviction Dismissed?

    My question involves an eviction in the state of: Washington State outside Seattle in Bellevue.

    I am a new property manager in a shared living space house. I am also a tenant who lives next to the guy the owner and I are trying to evict. He is a nightmare who stresses out every tentant in the house. He won't leave. This has been going on 2 months now and the court dismissed the first 20 day notice, due to outdated forms. The tenant is on a month to month lease.

    We went and bought a brand new eviction kit and started over. We got him with a 3 day notice to pay or vacate and even got a writ of restitution from the judge. Recently he went to court went to the evil free lawyer's who keep getting him off on outdated forms. The court house sells outdated forms and the free lawyer's know this and use it to keep dismissing cases like this. So instead of kicking him out on monday we are going to court to fight the free lawyer, who appears to have the upper hand again. It's like a bad twilight zone where I can't get away from this crazy man.

    Is there anyway to win on monday or is it time to hire an attorney and kick him out yet another month and a half later?

    I can't predict for you what will happen on Monday. If you can talk to a lawyer before your hearing (or find one at your hearing willing to help you out) go for it.

    Note that in a lot of courts, there are attorneys handling multiple landlord-tenant actions on any hearing day. Those lawyers often represent larger landlords, and they typically know how to process deadbeat tenants through the system and out of their rental units. Check the court docket for lawyers handling multiple cases on the landlord side, and try to talk to one of them.

    thank you for the reply. i guess it's a lesson learned, but i don't believe it's right for the court to be selling outdated eviction kits and the free lawyers to take advantage of landlords in that manner. i'll post what happens tomorrow though, and check the court docket.

    we ended up making an agreement with the free lawyers for the tenant to be out by the 20th of this month. the lawyers would have won in court. the agreement starts a 20 day notice as of today, not the 10th. If he doesn't move out by the agreed date we will server him a summons and complaint.
