Default Statutes of Limitation on Assault and Battery
My question involves criminal law for the state of: Virginia

Greetings All:

In early May of 2008, a male acquaintance assaulted/battery to myself, my boyfriend and damaged our vehicle by scratching, jumping on the car and grabbing onto the window to hold himself on to the vehicle while we were attempting to leave. We did not file charges however assuming that based on our conversation with him, we would not file the A/B incident and dissolve the friendship and take any damages to the car as a lost.

In July 2008, the male acquaintance files at Small Claims court for monies that were owed to him by me. Now, that I have been dragged into court for small claims, he has not acknowledged the A/B and damages to the car which is more than the monies he is seeking. Since, the court appearance I have decided to file charges for A/B and damages for my car.

My concerns are: What are the statutes of limitation for A/B?

Typically, a cause of action for assault and battery must be brought within a year of the incident.
