    Default Providing Collateral for Someone Else's Loan

    My question involves bankruptcy in the state of: UT

    I provided a house as collateral for someone else's loan.
    The person defaulted and now the lender is foreclosing on my house.

    I don't owe this money--I never signed the promissory note. I just provided the collateral. May I file Chapter 13 BK to stop the foreclosure or will the courts say it's not my debt?

    Alternatively, may I file an involuntary bankruptcy petition on the person who is responsible for the loan?

    Have your bankruptcy lawyer review whatever it was that you signed, making your home collateral for the loan. I can't tell you the implications of a contract I haven't seen.
