    Default Getting Paid

    My question involves alienation of affection law for the State of: Illinois. I recently found out the woman I intend to bring an alienation of affection lawsuit against has filed a wrongful death suit in chicago illinois/cook county. Her child's father was killed by the police and the lawsuit, filed by her, is on behalf of the child. Would I be able to present this to the judge as evidence of her ability to pay damages?

    Only if she actually was awarded damages.

    Are you quite certain you want to go through with an AA suit, and the public circus that entails?

    She is bringing the suit on BEHALF of the child because no one owes HER any "damages" as a legally unrelated party - and any amount awarded would likely be held in trust for the child - meaning: it's not the mom's money, but the child's money - and you have no claim to assets held in trust for this child.
