Default My Husband is Not My Child's Father
My question involves paternity law for the State of: Tennessee
At the time of my daughter's birth my husband and I were going through divorce. After our separation I become pregnant by another man. My husband and I are still separated and currently still married.
I would like to establish paternity for my daughter, but I am told I have to eliminate my husband as her father before pursuing her biological father.
At the time of her birth no father signed her birth certificate and she has my current last name.
I just need some guidence on where to begin and will I have to pay for the testing to eliminate my husband as the father?

In most states, since you were married, your husband is recognized as the father. If you are getting state assistance, expect that they may come after the husband for repayment. You will need to go to court and petition for child support. The court will order the paternity test. This can also be settled during the divorce (getting husband off the hook)

Well I would sure hope so. Who do you think should pay for it? Your husband didnt get you pregnant do you feel that he should have to? I mean no offense here but honestly ..
