    Default Bad Check Charges

    My question involves criminal law for the state of: Alabama

    My aunt was recently made aware of misdeamor bad check charges dating back to September 2003. What is the statute of limitations on this? She was arrested when stopped for speeding. She has an upcoming court date.

    Bad check charges typically have a statute of limitations of two years.

    Do note the difference between a "bad check" (you didn't do the math correctly) and a "hot check" (you knew you didn't have the money and wrote the check anyway).

    Are you sure it's misdemeanor charges? Like Missy said, the SOL is typically 2 years, BUT, if the charge/warrant was renewed to restart the SOL then the local law enforcers must deem it rather weighty. Usually renewal/re-issue is reserved for felony occurrences and/or serious misdemeanors.
