Default Domestic Assault Now Becomes Simple Assault
My question involves criminal law for the state of: VA

My ex got his lawyer to change the charges from DV to Simple Assault because he could prove that he had a permanent address somewhere else (even though he lived 6 days out of the week with me for 6 months!!!!!!). So what can I expect now? Is it a lesser charge than DV, with less consequences? What sentence that charge carry? I guess being in the military and the threat of not being able to carry a weapon really got both their wheels turning and try to come up with something....Now the court day is postponed! I am so sick of it!!!!!
Please help, I appreciate it so much!!!

Your sweetie's lawyer didn't change the charge; the government did.

And now, tell us what state it is in and what is the statute number under which he is charged.

Thanks for your reply.
I am in Virginia, and I don't know the statute number under which he is charged. Last time I heard it was still a DV Charge but the secretary at the DA's office told me it would be change to Simple Assault and the case will be pulled out of Juvenile & Domestic Relation Court and transfered to General District Criminal Court.
