    Default Motion to Dismiss

    My question involves bankruptcy in the state of: FL
    We have been in b/k since 5/05 and have made most of our payments on time or got them caught up. We just received a motion to dismiss. The trustee gave a figure that is actually not correct, my question is, if we catch up the payment, will we still have to go the hearing? My husband lost his job again, so making the payment on time has been difficult.

    Talk to your bankruptcy lawyer - did you use one?

    The trustee has a responsibility to look at the rights of creditors too.
    They don't file motions to dismiss lightly. I strongly suggest you seek legal advice from a competent attorney and YES you absolutely need to attend that hearing unless you receive a letter from the court his motion is withdrawn!
