    Default Marriage visa, and divorce

    My dad brought over a woman and her son from belaruse. She never lived with my dad the 20 somethings days before they were married. Were married on a monday afternoon at the JP in Ohio, (my dad lives in Michigan) and come that Thursday afternoon they decided to call it quits. She never lived with him, stayed with him durring that time, she lived with her sister. It was to my dads understanding that they (her and her son) would be living with him. He made a very adiquate attempt to make a comfortable home for them. But seeing that there was no pleesing, he had enough. They never "consimated" the marraige. They own no property together, nothing. Is it possible for him to get it annuled in Michigan. How long does it take. Or does he have to go though a divorce. How long before she can be shipped back to where she came from. Does he leagaly have to pay for her to go back. She was well off with a good carreer and home etc over there. He paid for EVERYTHING to bring her and her son over here. Expecting a real marraige, and life with this woman that he "loved". Also, is there anything that he can send to the INS, or her government to see that she doesn't do this to any other hardworking american man.

    It's possible given the facts you describe; he should get the assistance of a lawyer to petition for an annulment, as Michigan has a strong presumption in favor of the validity of marriages. If he delays taking action, he'll likely end up having to get a divorce.

    That's up to the USCIS. His obligation to support her depends upon whether he signed an affidavit of support.
