Default How long comp claims stay open
My husband is a mechanic and was hurt last summer. Everything was covered under work comp at his previous employer. The representative from the workmans comp company said that if my husband ever had back trouble again in the future that it would be covered under this claim. The doctors office also said that claims stayed open for 10 years.

Last fall his company was sold and another owner came in and terminaated all the existing technicians jobs. He is now at a new company and the same back trouble has started again. The work comp lady told us that he needs to fill out paper work with the new company and she will not cover it.

The doctor's office told us that becuase the claim was to be open we should get a lawyer and take her to court. We are somewhat confused and are not sure what we should do.

We need information on the laws in WI.

Default Pursuing Claim Through a Lawyer
From what you have posted, it appears that the company closed your husband's claim prematurely, and is now trying to use that improper act to prevent him from obtaining workers' compensation benefits. I think it would be a good idea to follow your doctor's advice, and to consult with a workers' compensation lawyer in your state. The initial consultation should be free.
