Default Florida Rules Concerning Withheld Adjudication
Here are some details to start you off. First of all I have been convicted in 1985 for a Felony and served my time in the state penal system. Almost 12 years later I applied for a job and they did a background check that searched, I assume, only 10 years back because I came back "CLEAN" and was hired. About a year ago I plead guilty to a Petty theft charge for taking some beer from a convienance store. My sentence was for Probation,community service, fines, and upon completion that adjudification would be withheld.
MY QUESTION: Will this Petty theft charge be on a background check should I go to apply for a job?

Typically yes - it would normally show up with the notation that adjudication was withheld.

What if you are given a Withheld Adjudication right at the sentencing after the trail - and the Jury gave you a guilty verdict?

Does the charge that I was given initially get renamed to only read "Withheld Adjudication"?

So, I was guilty of something, but is unknown?

hello recently the florida dept of corrections put a felony cocaine charge on my criminal record that showed a felony conviction in 1990 that wasnt mine nor have i ever been arrested for it.the original charge was marijuana and i was placed on 18 months probation with adjuication with held. after calling them and getting the record corrected they couldnt explain how it got there in the first place.im a truck driver or was thanks to there mistake it this charge has now shown up on my d o t dac report and shows i was a convicted felon, which wasnt on there in january 2008 when i hired in to a trucking co. when i was sentenced to probation for the felony marijuana charge i was told it wouldnt show a conviction on my record and that legally i wouldnt be a felon and could legally say that on job applications that i wasnt convicted and have my rights a felon wouldnt have. so could you please explain to me what adjudication with held truly means compared to adjudication. because now my record shows the correct charge with adjudication with held and it shows felony probation on it which in the trucking co is the same as a felony conviction when it never did before and my recent copy of my d o t dac report shows cocaine conviction and i can not get hired any were and been out of work since march 2008 and i am flat broke and the attorneys want 6000 to 8000 retaniers to help me .i cant even get hired by a grocery store to be a meat cutter a job i been doing for 34 years until july 2007 when i became a truck driver and im a master cutter and worked for years with major chains such as publix winn dixie meijers etc. and a felony charge never came up before ever i dont know what to do now im behind on bills n florida child support .so could you tell me how this can be and could you referr me to attorneys who can help me on a contingent basis because im dead broke or some agency that can help me in court and filing papers.i am in michigan and been since 2001 and i really could use some help on this matter my email is kgt669@hotmail.com if you or any attorneys can help please email me there with a repsonse here as well thanks
