    Default Drug Testing at Plea Hearing

    I was charged with possession of marijuana on 10/31. I did drug testing on 11/30 as a part of my bail agreement. I have a plea hearing with the circuit court on 12/12. I'm wondering if I can be asked to do drug testing again on that date? or do they have to wait for me to be sentenced. My lawyer said we're looking at the 7411 or the Holmes Youthful Trainee Act. I'm currently 19 years old. This is also my first offence, but it is a felony through circuit court. Please help...

    Dude - stop using. Do you want to do jail time?

    Check the terms of your bond - particularly given that you have already been tested once, abstinence is likely a condition, and judges who suspect continuing use can order you tested.

    As I understand Michigan law, a Section 7411 disposition would be better for you than HYTA, and shouldn't disqualify you from getting HYTA if you get in trouble again (although it would certainly be considered by the probation officer). But either way you would avoid a conviction - if you successfully complete probation.
