    Default Reckless Driving in Virginia

    My question involves a reckless driving ticket from the State of: Virginia

    I was driving on I-264 West bound and got off on the frederick blvd exit. i stayed right off the exit to go towards high st. At the end of the exit is a yield sign for a two lane road. about ten yards after the yield sign is a set of rr tracks then about 30 yds after that is a 4-way intersection.
    ok so i was going about 20-25 off the exit, ahead of me i saw an SUV about 3/4 of the way on the left hand shoulder with its left turning signal on. i figured either he was an idiot since you can only go right there, or his hazard lights were on and the right signal was broken. i went around him, i didnt even have to turn the wheel to go around him. i slowed to about 15-20 and looked around the suv as i neared it, i saw a motorcycle in the left lane about 20-25 yds back. i pulled out in the right lane, as i got over the rr tracks i had to stop becuase of traffic from the light being red. the motorcycle pulled up beside me with its lights on, it was a sheriff, told me to go around the corner and pull over, the SUV then passed us on the left and the sheriff flagged him also and told him to pull around the corner. when we were all stopped the sheriff walked over to me, told me to get my license and registr. ready, then he walked forward to the other car and talked to him for about 10 seconds. he then walked to me and told me he was giving me a reckless driving ticket for almost hitting him when i pulled out. i said thats impossible becuase he was in the left lane and i turned into the right. he then said i pulled around the SUV which i then said it was in the shoulder with its left blinker on. Also he was PISSED. he then let the SUV pull away.

    my question is, am i wrong or right? First i beleive the cop was mad becuase he wasnt paying attention and got scared becuase i pulled out from behind a car on the shoulder. second, he was black, i am white, the suv driver is black. not being racist but this area is predominantly black. third, its a big city and i was under the assumption deputies are not supposed to get in traffic matters, i know they can but i beleive theyre not supposed to. any help will be appreciated. any questions needed feel free to ask. i will be taking pictures and measuring the distances also, i can post here if needed.

    Sounds like the guy in the SUV missed his turn earlier on the ramp and was trying to figure out how to get back the way he was supposed to.

    If you turned into the right lane and he was in the left lane then I think it sounds like there's no way you should have gotten a ticket...

    yeah and i said that to the sheriff. he still thought that i could have caused an accident. my court is friday morning, weird i get the ticket on monday and the court date is friday. i called the sheriff and he said he doesnt know why it would be reckless driving, he thinks the deputy just got mad. he also said he writes about 100 tickets a month.

    update

    just realized the deputy wrote the wrong location on the ticket. it was the I-264 offramp to frederick blvd, but he only wrote "offramp to I-264 WB"

    not sure if this will help me.
