    Default Firearms

    My question involves criminal law for the state of: PA

    Hello, and this is my first post, so if it's in the wrong area forgive me. I was recently convicted of Theft, misdemeanor 1, and Corruption of Minors, misdemeanor ?. At first I thought I got passed the felony law for gun ownership, but a paper I signed confused me. It states:

    A "felony" is defined, under this section, as any offense punishable by imprisonment for a term in excess of one (1) year. This shall not include, however, any State offense classified by the laws of the State as a misdemeanor and punishable by a term of imprisonment of two (2) years or less.

    I told my Parole officer that I wasn't convicted of a felony, but he said that because my maximum punishment was 5 years, that I was incapable of ever owning a firearm again. I reviewed this statement, and I don't see where it says it anywhere, but the more I try to figure it out, the more it confuses me. Also my punishment was 20 days - 1 year parole max, so I don't see how this works. Any help would be appreciated, thank you.

    Basically, it says that if you COULD have been sentenced to more than a year, you can no longer own a weapon.

    Not what you were sentenced, but what you could have been.

    You are able to file a hearing with the gun board. To have your right to gun ownership returned. It is a long and lengthy and time consuming process. But it is possible.

    Federal law also prohibits you from possessing a firearm.
