    Default Englishman Illegally Here 10 Plus Years

    I realize this is not a good case. He has no children or family here. He has a great girlfriend for 3 plus yrs. He is from England. Good man no real criminal problems but I think a DUI years ago. I think he and his girl wanted to get married anyway. What is his most likely outcome, what would be the wait before reentry possibilities and should he marry prior to leaving the states. He did turn down another marriage years ago since he didn't love that girl. He is a good man. Thnx for any help.

    Did he enter legally (on a tourist visa or such), or did he enter illegally?

    The answer to that makes a difference.

    He Came Legally Met A Girl And Stayed. He Was Offered To Get Married But Did Not Love Her To That Point And Didn't Take Advantage. HE IS APPROX 42 YRS OLD SO THERE IS NO TIME HERE UNDER 18 YRS OLD.

    He can marry and petition for adjustment of status, as described in dozens of threads in this forum. Whether or not his possible criminal conviction(s) would interfere with that process is not something we can answer, because we don't know the specifics.

    Is this the guy who has already been deported (and who, in your other thread, appears to be you)? Then marrying won't fix things.

    Getting married won't cause the deportation proceedings to cease. If you're in deportation proceedings, you need an immigration lawyer.

    Thankyou for your time. This is actually for a friend of mine. We realize there will be a penalty. Just trying to minimize the time he will be barred from the US. He is a white European. Should he try to fight the public drunk charge (misdemeanor B) or does it matter. If he is deported prior to that hearing for drunk in public what comes of that charge.
