Default Collections After a Repo
My question involves an auto loan or repossession in the State of: Michigan

Long story short I had a car I called the bank to come & have voluntarily repossessed. Instead they sent a repo agency who snuck in and took the car in the middle of the night(so I had no chance to give them the keys) & now it is listed as an involuntary repo on my credit report.

I've checked my report recently and despite the debt being disputed(I've never heard back from them after I sent in the letter certified mail so I know it got there) & now the report states I owe the full amount, after it was sold for $9,000 AND that they have payment arrangements made and I am behind on the payments.

At this point I've decided I'll be filing bankruptcy soon rather than fight with this agency.

My question is, I recently married(8 months after the repo) & moved to NC from MI. My husband would like to add me to his bank account so I have a debit card while he is deployed to Iraq.

I can not work at this time because of a high risk pregnancy so none of my money is going into his bank account, would his account be in jeopardy of garnishment if my name is on it?

Thank you.

~K.

A repo is a repo. Just because you call up the bank and say, "I don't want to pay for my car any more, come get it," doesn't mean they have to send... who would you expect, a teller?... to your house to get the keys and drive it away.

If you're planning to file for bankruptcy, file your bankruptcy before your husband adds you to any joint accounts. Otherwise, creditors who get authorization to garnish your accounts could end up taking his money.

I never said I asked for a teller to come to my house. I said it was listed incorrectly as an involuntary repo, I guess you don't care if your records are incorrect so you assume the rest of us shouldn't either.

As for the other part I've spoken with my lawyer now & guess what, you're wrong again. They cannot garnish his bank account for a debt incurred prior to our marriage when none of my income is going into the account.

I am really surprised, I came here a few years ago for some advice and everyone was very helpful, you however are just rude and incorrect.
