    Default Bad Credit Discrimination

    My question involves labor and employment law for the state of: IL

    I am 22 and I have under $3,000 in consumer credit card debt and an obscene amount in student loan debt. I have been trying to get a "summer" job for the last two months. I have applied to like 30 jobs and I haven't received a peep.

    I know my credit is not good but what are the odds that I am not getting a job (and not a fancy job either) on account of it? I also quit my last job and was fired for being late too many times from the job before that. I know that when places call the previous employers that they are probably giving them reasons not to hire me. What should I do? I need income and I need to put down that work experience (bookstores: Borders and Barnes) and I think that they are making it impossible for me to get income. Legal advice at all?

    I'm betting your work jistory is hurting you much more than your credit report.

    I know that when places call the previous employers that they are probably giving them reasons not to hire me.
    Nothing illegal about that as long as they are true or opinion.

    Even if the reason you aren't being hired is due to your credit hx, that is not illegal. Credit history is not a protected class. Discrimination has to be tied to a legally protected class such as race, religion or gender. However; based on your post, the reason you are not getting hired may be due to something other than your adverse credit history.

    You will just have to keep looking until someone will take a chance on you.

    While I agree that credit history is not a protected class, if a person actually declares bankruptcy, that can not be used against him/her in employment decisions based upon the Bankruptcy Act : http://www4.law.cornell.edu/uscode/11/525.html

    But I agree that it is probably not your credit history but rather your employment history itself that is causing the issues. Also many places don't want to hire a person who is only going to work for the summer. They want someone who once trained will stay around for a while. Because turnover costs the employer money.

    I agree re the bankruptcy but here OP is just talking about an "adverse" credit history (ie lots of debt) from what I gather from the post & not a bankruptcy.

    However, it was a good idea to mention re the bankruptcy protection.

    I think we all seem to agree though that it might be something other than OP's credit hx that is keeping OP from getting employed.

    I might add that even though the Bankruptcy Act noted above does offer some employment discrimination protection re bk, there has been some difference of opinion as to just which employees/applicants it applies & when it applies. (ie protection applying to private & government employees if already hired when bk filed but protection applying only to government applicants when currently applying for a job - private employers can consider bk hx on current applicants) The Dept. of Justice can answer bk questions.
