Step-Parent Adoption

My husband has custody of his son from his first marriage and has since he was 2, he is now 13. He has had minimal visitation with his biological mother. She was ordered to pay child support and has not done so in a year. Her payment is only $175.00 a month. She also moved to Florida over a year ago and hasnt had any contact with Jason since Dec 18th, 2004 when he told her he didnt want anything to do with her anymore. We have no address or place of employment for her. She has moved twice and only leaves us a phone number that is registered under a mans name. She has called 3 times in the last year and left messages, but Jason does not want to have a relationship at all with her anymore. He sent her a letter telling her this. What can we do as far as terminating her parental rights or having him amincipatated from her? We could care less about the support as it is so minimal. We just want Jason to go on with his normal life and not have to deal with her popping up again.

Yes! We want to do that. However, since they have joint custody wouldnt she have to consent? There is NO way she would even though she is mearly a womb doner to him at this point. I have been mom since he was three! We think thats why she calls and leaves messages every three or four months just so we cant file for abandonment. Since we have no address on her can we file abandoment even when she calls periodically? I know my son would go to court and say that he wanted this.
