Default Texas Delivery of Vehicle Refused
My question involves an auto loan or repossession in the State of: Texas

I searched the forum and could not find this unique situation.

In Texas I have signed the contract for a car deal. The dealer has funded the deal and sold the contract to a lender..

The unique issue is, The vehicle has NOT been delivered into the possession of the buyer. So since I have never taken delivery of the vehicle.. is it a completed transaction or does the dealer have to do a flat cancel on the contract. I have gotten a lot of conflicting answers from different dealers about this issue. It is my understanding that the transaction is not complete until you take delivery. Once that happens, then there is no buyers remorse in this state.

Why has there been a delay, what has been the length of the delay, and when is the car expected to be delivered?

Did not take delivery on when contract signed. I have no intention of taking delivery of the vehicle at this point. The contract was signed over 35 days ago

Your choosing to breach the contract by refusing delivery does not serve to release you from the contract.

When you sign for a loan with a lender, you owe the loan. No matter what happens to the car, you promised to pay the loan.

They have full legal recourse to take you to court and trash your FICO scores. So try to work this out to your benefit.

I failed to mention that this was a POST DATED contract. Does that help my case?
