Hello, I wrote in here before a couple of times. The last one was about filing for sole legal and physical custody. What I feared most has happened. Friend of the Court proceeded with delinquent child support charges on my ex-husband. They ordered him to pay me over $6000.00 by February 1st. He got pissed. Now he is suddenly demanding to see our son who is almost 4.5 years old. He has made no effort to have or maintain contact with him in over 14 months. Our son does not know him in any way. He has no memories of his father and can't even point him out in a photograph. My ex now intends to take this child whom he has shown no interest in for over 14 months and take him to his newest address (6th one in 6 months) which he has NEVER notified me of, however I did obtain it from the FOC hearing. anyways, my boy has never been there and will know nobody, his father included.
I have attempted to get him to speak with his father and he won't even get near the phone, but runs off. My ex will quite literally take him from my arms kicking and screaming and not be concerned about the child in any way. (He did this the first time he saw him after kicking us out of our home).
There is still a court order saying he is entitled to this time at Christmas, a motion has been filed to modify the parenting time, but that is not to be heard until January 18th. I'm not saying he can't see him, I'm saying that there NEEDS to be some time for them to be reacquainted before my ex takes him for such an extended period of time. My lawyer has said that he has met all the conditions set forth in the order so is entitled to the time. Does it make him a bad parent? Yes, will the courts care? not really.
My question is, is there any kind of an emergency motion or something that I can file to at least go before a judge and request an introductory period of sorts before he traipses off to some alleged address on the other side of the continent??
