    Question Minor in Possession of Alcohol

    My question involves criminal law for the state of: Texas

    I went to a party and chose not to drink. I was only there to hang out with my close friends. Cops came and gave the people that were drinking MIC's and the people that weren't drinking MIP's. I was given an MIP.

    My question is, how am I in possession of alcohol if I do not touch or consume an alcoholic beverage?

    You may be in "constructive possession" of alcohol, even if none is in your hand. We weren't there, so we don't know what the circumstances were. In any event, if this was a mass ticketing, you may find the prosecutor ends up engaging in some mass dismissals or mass favorable plea bargaining.
