My Girlfriend Wants to Get Emancipated

My question involves emancipation laws for the State of: New York


My girlfreind and I recently had a baby on february 29th 2008, we have been together on our own for about a year even though we were staying with family members from both sides of our families. We were recently staying with her mother and were kicked out, she wants to get emancipated so we can get married before I enlist in the services, she is 17 and I'm 19, is there anything we can do to get past the fact that she still needs consent even though being emancipated for us to get married because none of her family will sign appropriate documents?

Not really. She has not lived on her own... she does not have a job... and being pregnant makes the process harder by an order of magnitude even IF you had all of the consent.

Your job... especially since you are about to join up... means nothing.

Who is supporting your family while you are in the military?

i will be, ill be getting paid weekly and that money will go directly into a joint bank account that the 2 of us share so that way she can take care of the baby, and im getting a job on the side because im only joining the national guard so i wont be gone all the time and i already have the job so wouldnt that count as having income coming into the house so she will be taken care of plus having our own place would be consider living on her own right?

Being emancipated doesn't mean living off someone else's income. It means being independant.

She is not.

Oh and one more thing if it is a custody issue where the person who has legal custody is her grandmother. Is her grandmother legally the person who would have to sign the consent forms for marriage or could her grandmother sign them?

Someone can correct me if I am wrong, but I don't believe that NY has an emancipation statute anyway.
