Default Minor in Possession and Consumption in Indiana
My question involves juvenile law in the State of: Indiana

I took my 15 year old step-daughter, who I have legal guardianship of, camping over the weekend. I allowed her 1 beer after dinner. DNR Police came and gave her a breathalizer and she apparently didn't register, because I was not told of a BAC. I was given an infraction, and I'm sure I'll have a fine to pay. However, she was given a court date. This is her first offence. She's a great kid, but I made a big mistake. What can we expect in court?

Well, since all state and federal parks prohibit the possession and consumption of alcohol... you may have several issues.

Your step daughter was a Minor in Possession.

You were caught giving your 15 year old daughter beer.

I would plan on child protective services to be called.

They had no problem with the alcohol being in my posession. I was just given a ticket. But I don't understand why she was given a court date. Seems like I would have been the one to be in worse trouble.

You may have been in the handful of parks that have okay'ed consumption by legal adults.

Your daughter is not a legal adult.

Now for the tough question. Have you told your step daughter's other biological parent yet?

You can bet your sweet bippy this is coming up at the next custody hearing.

I have not spoke to her yet. This just happened. There are no custody hearings, though.

You say you have guardianship. How has legal guardianship been documented?

Through the courts. We were never told of any custody hearings at the time of the guardianship.

Please be more specific.

Are you the custodial parent of the child because the child's mother has signed over her rights to you?

What is the role of the child's mother in her life?

Or are you saying that you are married to the custodial parent.

There is a huge difference here.
