    Default Re-Entry After Visa Denial Because of Two Day Overstay

    Hi,

    Thanks for taking the time to read my post.

    I am married to an american citizen (OHIO) and we live abroad. Every summer we visit his family in the US. I was previously able to enter the US on the VWP.

    My 2nd visit to the US I overstayed my visa unknowingly (booked for 90 days exactly and did not account for the summer months, 2 of which are 31 days)
    I entered the US again a few months after that and there was no problem, i was let in but then the fourth time I tried to enter they said I had overstayed my visa (the second time) and was refused entry.

    That was 5 years ago and since then I did start an imigration application thinking it would be easier to become a green card holder but then I did not get all the papers I needed in time and the application lapsed.

    My intention is not to go live in the US at this time, my husband and I now have a son and we would like for his family to be able to see him.

    I have applied for a Tourist/Visit visa through an american embassy and on the application I mentioned my refusal. At the time of application they are supposed to tell you if you have been granted or refused and now it has been
    6 months since I applied. I have repeatedly asked for an answer but I keep getting replies saying that they are still processing my paperwork.

    Is there an easier way to do this? What should my next step be?

    I suspect that between the overstay and the dropped Green Card application, they are suspicious that you have the intent to stay in the United States and are thus putting your visa application through a more vigorous vetting process. You can check the status of your application online. Unfortunately, beyond that, there's not much you can do but wait.
