Default Voluntary Repo of Auto in 2001
My question involves an auto loan or repossession in the State of: Florida
I now reside in Pennsylvania, I voluntarily gave a car back to dealer when I could no longer make the payments. Now 6 years later the creditor has turned this over to a collection agency. Yesterday was the first time I have been contacted about this. Is there a statute of limitations regarding this debt. I am now living on SS disability and really do not have the income to resolve this. Do I have any options???

Did the creditor obtain a deficiency judgment against you, or is this just a straight collection attempt?

If they got a judgment allready in florida YES they can come after you almost forever....

BUT
If you have not been to court and you do not have a judgment against you allready for this issue THEN you are free and clear my friend... the florida statute of limitations is 5 years and Pennsylvania is only 4......

NOW I am auusming they can not toll the statute for some reason....

Also, how would I find out if a judgement was entered, the only mail I have received was from a collection agency?
