    Question Lesbian Couple, Sperm Donor Rights and Adoption

    My question involves paternity law for the State of Florida.

    My partner and I are about to enter into an agreement with a known sperm donor to have a baby. Since Florida does not allow for same sex adoptions, my partner won't be able to adopt my child. Is there another way for me to protect my partner in the event that I die so that she will receive full custody of our child? I also wanted to know what the Florida Laws are about sperm donors.

    If anyone can answer my questions, that would be very helpful!

    This case from 2002 affirms that sperm donors in the state of Florida are non-parents, and thus have no rights to the resulting child.

    You should really hire an attorney to help you with this. I cannot stress this enough. Florida is hardly a GLBT friendly place, you need someone intimately familiar with the state's laws to ensure that your partner and your future child are properly protected in the unfortunate event of your death.
