Default Repo with No Contact by Lender
My question involves an auto loan or repossession in the State of: NC, FLA

We purchased our car in Fla in 6/05; made payments, moved to NC and car was repo'd in 6/07. At that time we were about 4 months behind. Last payment was in 2/07. We have had NO contact from the lender .. not even an acknowledgement of the repo. How long can they wait to contact us? How long is the SOL? Is there anything I should do? Does Fla law apply since the car was purchased in Fla? We have since moved back to Fla, so I assume they would have to sue in Fla.

I am sorry to hear about your problem. With your moving around it is possible that they may have sent mail to a former address.

I am sure that by now they have re sold the auto. You should check your credit report. See how much the charge off was after the sale of the repo.

You are responsible for any shortage to the lender along with repo costs, interest on the loan, legal fees etc.
