Default Did This Repo Company Do Wrong?
My question involves an auto loan or repossession in the State of: Florida.

Hi guys, first time posting and thanks in advance for reading and helping.

I last week spoke with Nissan (NMAC) as I am three months behind on my truck payments. I broke my leg in February and it costs me a lot of time and money. Just last Monday I sent them one payment via Western Union and called them back with the confirmation number.

I had a long conversation with them and they assured me they would take zero action now that they have received a payment as long as I keep up to my agreement which was to make two more payments in the next month which is now OK for me to do.

Anyway.............. I come back from the store today, go outside again two minutes later and the truck was gone!!

Here's where this gets horrible!
I see the repo guy up the street so I drive up with a buddy in his car. I had my baby in my arms and was very upset so I got into the vehicle the guy was trying to take. So there I am with my two year old sitting in my Nissan Titan.

I noticed too that the repo guy had a girl in his truck, she looked about 6 or 7 years old.

What happened next is crazy. The repo guy, knowing we are in the vehicle, hooks it up from the back wheels and drives off draagging us behind him!! I was scared out of my mind.

My buddy tried to stop him and managed to. He got out of his car and yelled at the repo guy telling him there was a baby in the damn truck he was trying to snatch. The repo guy said "I don't give a crap" and took off again, tires dragging across the road, not properly hooked.

This happened three times before I was able to get the cops there.
Good ole cops, they made us get out of the truck and not only did they let the repo guy go without saying much to him at all, they are filing charges against me with the State of Florida for Child Endangerment!!!

When the repo guy saw me get in the vehicle I think he should have just stopped and maybe called the cops himself but instead of that he drove like crazy through a residential neighborhood with kids everywhere, a baby in the truck he's trying to take and a kid next to him in his truck!

I am absolutely going to take this further, maybe I shouldn't have gotten in the vehicle but should this idiot have dragged us up the street?
Should he be doing repo's with a young girl in his truck?

Any help or feedback is much appreciated.
Oh, and thanks Nissan for screwing me over!!

It sounds like the police regarded the repo as complete when you discovered it and hopped into the back of the car with your baby. You did endanger your baby through your actions.

The repo man will presumably deny any knowledge that you sneaked into the car after he completed the hookup. Is that what he's already told the police? If he told the police that he saw you get in, if I were the cop I would have cited him for something as well.
