Default When can a creditor put a lien on your house?
hello I signed a contract with an alarm company and kept them for 3 months. I had too many issues with false alarms waking me up in the middle of the night scaring the heck out of me and my family. I have a toddler and a two year old so the false alarms didn't help much. The company tried several times to fix the problem but every tech that came had the same response that the alarm did not work well with my digital phone and that I would continue to have problems until I changed phone companies. I thought that was ridiculous since I had digital before they installed my alarm and they were aware of it while the installation but didn't mention anything that my phone could cause malfunction. I called the company and talked to the manager and explained the situation. The manager himself said that the alarm would not function properly with my phone. I asked if he would cancel my contract since they seemed unable to fix my problem and I had my phone before they installed the alarm. Ofcourse he said no and warned me about the 3 year contract and that it stated on the contract about digital phones not working with their phones. I read my contract and it says nothing about digital phones. I cancel my contract with their subcontractor but the alarm company still sends me to collections without notifing me and now the collection company is threating me on putting a lien on my house. What can I do? please help!

Default Breach of Contract
Sue them for breach of contract, and ask the court to excuse you from the balance of the contract (past the initial three month period).

Default Suing Alarm Company
You said there isn't a lien yet, so... there's no lien to remove.

Go to the courthouse, find the clerks office that handles small claims matters, and ask for a brochure on small claims court. Most courts have brochures with instructions and forms. You can also look for your county court's website, to see if they have any instructions or materials you can download.
