Default Illegal Repossession
My question involves an auto loan or repossession in the State of: Texas

My jeep grand cherokee was repossessed this morning by omni america credit union and I called them at 9.00 am to make the past due payments of march, april and may and was told I could not do this since I am not working at this time.. The reason I dont work is my fiance does not want me to and is paying the bills for me.. I added him to the acct so that he could speak to the lady.... (i use that term lightly) about this problem and was told since we are not married he cant make them... I dont understand how this matters.. If I was a hooker or something they are still getting the money.. I cant believe this can happen in America.. I am being forced to get a job when I dont need one.. That makes no sense...

How is this legal (if it is) for them to take my jeep and resell it for double what I owe... I only owe 7k and was told they would not refinance.. I am not asking them to refinance as it was just taken today. I only want to pay the past due balance and get my vehicle back.. If anyone knows if this is legal or what I can do please let me know as I am at my wits end and cant afford to hire an attorney..

I am not sure what your question is.

You were three months behind in repaying a loan.

They came and got the collateral.

Is all that correct?

Yes all that is correct.. My question is since they were working with me and it was just repossessed today is it legal for them to not accept my past due 3 full mths payment since I dont have a job.

The repossession was legal after 90 days without payment.

They rarely warn you when the are about to repo your vehicle.

I understand the reposession is legal... AGAIN my question is why are they refusing to accept the 3 mths past due payments I want to make to them because I dont have a job... I dont think that should have anything to do with it.. Where I get the money is not their business.. I could have been paying on it these 5 past illegally... I didnt but I could have.. How can they refuse payment based on that.. Stay at home moms do it all the time but because I am not married they are refusing.

Was a condition of the loan your ability to earn enough money to pay for the payments?

In other words, did you tell them how much you made and that was a factor in getting the loan?

But you didn't.

You keep saying that they refused your payments. You missed 3. That is typically all it takes.
