Default Domestic A & B
Hi
I hope you have some advice for me. I was arrested (first arrest ever!) for domestic assault and battery. My husband and I were driving home, I was driving the car and he was drunk. He was screaming at me all the way home. I kept telling him to shut up. I waved my arm at him and said "just shut up I can't drive with you screaming like that" BARELY touching his nose by total accident because he was moving looking for a lighter. He repeatedly grabbed the steering wheel while I was driving and I needed to stop the car several times to avoid getting in an accident. I locked him out and told him I'd let him in when he stopped screaming and calmed down. I asked him several times if he was going to come in and go to bed, he said no. He called the police and said I'd hit him. He wrote exactly what happened and the police said that may not be enough so he wrote another statement saying I punched him in the nose at a red light or stop sign. The officer asked me and I told her I had not hit him, she said his nose was a little red. I pointed out he had been outdoors for 15 minutes of course its red and its always a little red. He ran around to get $ to bail me out and now he thinks he can just have this dismissed - will it just be dismissed?

Default Domestic Violence
That will be up to the prosecutor who is handling the case.
