    Default Can An Employer Ask Why You Are Calling In Sick

    My question involves labor and employment law for the state of: FLORIDA



    I know that the employer has the right to ask for a doctor's excuse if the employee handle book state its company policy that more than 3-consecutive days.

    My question is, if you call-in "sick" does the employer have the right to ask or call you questioning the reason (diagnosis) as to what is wrong with you?

    Agree, of course they can.

    Usually employers enforce it as much as possible by asking for a doctor's note after 2-3 days. They only pressure the employees that are generally lower performing. Perform well and they won't question unless you work in a job where it is easy to replace someone (McDonald's line crew, for example).

    It is in many ways to your benefit that the employer have at least some information about why you are out. Refusing to supply that information can result in your not getting all the benefits to which you are entitled; FMLA, ADA protections, etc.

    The information provided by the other posters is basically correct, with the exception that the medical information and who requests it can be limited if the involved employee is a qualified individual with a disability (QUID) under the ADA.
