My question involves judgment recovery in the State of: IOWA
A few years back, when I was not responsible for any debts that I had, I had two judgments filed against me in two states. These judgments have been paid in full to date. Actually, they were PIF a little over 3 years ago.
I have been proactively cleaning up my credit history by paying other accounts that I have had. But the other day when I got my credit reports, I saw these judgments on the reports still listing the beginning balance of the judgment (already paid).
Now, being that I have never really kept up with my rights and responsibilities, I researched what should have been done. The collectors have never filed a Satisfaction of Judgment in relation to these judgments. I have contacted one of the courts for comfirmation of payments, but they have stated that a SOJ letter was never issued. The final payment for this one in particular was on 10/2005.
I really want to get this resolved. I called the creditor to get this letter, post dated back to the final payment, and am awaiting a response. (On vacation until 5-27)
Since this particular one was never filed when it should have been, and it is the same for the other, I guarantee. Is there any further harm that could be done to my report. Also, since one was never filed, is there a possibility that due to the other parties negligence that I can have these records vacated?
What are my rights? What else should I be doing?
Any advice is greatly appreciated!
Thank you for your time!
