    Default Item Sold Outside Of Ebay, Buyer Reversed Payment

    First of all to let you know, Im from England so bear that in mind.
    Firstly the buyer emailed me through eBay asking to sell my item outside of ebay. I agreed. They sent me payment via paypal and I sent the item recorded to the address provided through ebay. 2 days later the buyer claimed that their paypal account was hacked claimed their money back. I have tried contacting the paypal user and the ebay user without reply. I do want me money back and need help desperately.

    The things to take into account are..
    1. The buyer originally contacted me through ebay (not paypal)
    2. The buyer only claimed the hacked paypal account once they had recieved the item and signed for it.

    Sorry, Yes, both the me and the buyer are from/ in England.

    ...which, I'm sure you know, is a violation of eBay's terms of service. eBay is not going to help you, and likely will ban you from the site.

    PayPal, which is owned by eBay, will similarly not help you. You're not covered under PayPal's seller protection policy because it was an off-eBay transaction.

    Your only option is to sue in the UK equivalent of small claims court. For information about that, you'll want to contact a solicitor in your area.

    Do you think that I have a chance of getting my money back through a small claims court? What should I expect and how do I start the proceedings?

    if you are both in England, then the laws of England are going to govern what you can do and your chances of success. I have absolutely no knowledge of English law.
