    Default Fence Partially On My Property

    My question involves real estate located in the State of: Florida

    I am installing a new vinyl privacy fence. On one side of my property there is a wooden fence owned by my neighbor. According to my survey the back half of the fence is on their property and the front half of the fence is on my property. (The fence was built crooked -- and facing the wrong direction -- and is falling down onto my property.) They would not share in the cost of the fence down that side of the property -- which is OK with me -- but I cannot build my fence straight without removing the portion of the fence that is on my property. I have asked them to remove the portion that is on my property, but they have not responded to my request and my contractor will be ready to put up that side in another week. Can I tear down the portion that is on my property? Do I need to ensure that their property is still enclosed (this will be relatively easy to do)? My contractor will not have to trespass on their property to do any of this.

    I have not been able to find an answer to this on-line.

    I would notify them CRRR of what you intend to do and give them 10 days to remove the encroachment.
