Default Bank Won't Reposess My Car
My question involves an auto loan or repossession in the State of: Vermont.

Hello, I am in a strange perdicament.....I took out a signiature loan and a used auto loan.....was paying them both fine until i lost my job....even though the vehicle i bought turned out to be junk and was off the roand most of the time.......i paid 1400 on the 3400 used auot loan before i lost my job in july of 2007.....both of my loand were defaulted on in october for failure to pay and in late october i received a notice of intenet to reposess.....in february they send me a letter saying that i owe the full value of the loans.......i talked to my loan officer in a grocery store and asked him when they were going to reposess the car.....that way they could subtract whatever they got from the auctions or junkyard from my loan...minus thier expenses of course....he said they wern't going to they didnt want it.....no more letters came......now i get a court hearing paper in the mail....they are suing me for the full value of the loans......the car is sitting here......what can i legaly do.....i am still out of work and trying to get things together to apply for disablity...bad leg and some mental issues keep me from being gainfuly employed....
any help would be great......ps the total on both combined loans is just over 4000 dollars.

Try to have it made explicit in the judgment that when you pay off the judgment they'll give you clear title? Pay off what you owe, so you can get clear title without getting a judgment entered?

they do not have to repossess the car. You contracted with them to pay them a certain amount of money and they simply want you to live up to your contract.

So, what can you legally do? Pay the loan is the obvious one but apparently that is difficult at the moment. Other than that, not much.

Mr. K has offered suggestions for when you go to court to answer the suit.

Those seem to be your best action available.
