    Default Fraudulent Injury Claim, Bicycle vs Car

    My question involves an injury that occurred in the state of: California

    Making a right hand turn from an unprotected street a bicyclist hit the right front fender of the car. No one was cited at the scene. The report stated the cyclist received a contusion. Our insurance company received a letter from an attorney. When our insurance company tried to contact the attorney for more information and see the bicycle the attorney did not respond so we thought the case was finished. 3 1/2 years later we have been served with a 1.4 million dollar lawsuit for medical and property damages.

    We have just been notified that the attorney will not settle and wants a jury trial ... so now we are headed for trial. I am not sure what kind of a lawyer I should be getting. I feel this is totally a scam.

    Any help will be appreciated. (This happened at night, in the rain and the cyclist had no headlight, no helmet and was in dark clothing riding on the sidewalk on the wrong side of the street)

    Has the insurance company you had at that time been notified of the lawsuit?

    Yes my insurance agent has passed this on to a legal firm and their offer was not accepted.

    Alright, it sounds like your insurance company has an attorney/law firm that is currently trying to settle the matter.

    You can ask the insurance company what law firm that is and ask them your questions. You should be working with them so you are well informed on how the case is going.

    If need be, they may recommend that you hire a personal injury defense attorney if this case is going to exceed the limits of your policy.
