My question involves criminal law for the state of: Colorado.
My husband got kicked out of a bar and arrested in 2002 and ended up being convicted of 3rd degree assault. The judge released him without charging bail or jail time and he was ordered to take anger managment classes. Well he had only been in the country for a couple years and being from Brazil, didn't know english very well. He was even told by his translator to just plead guilty and they'd let him go.. which they did. But... once he went in to talk to his counselor or PO i guess... the guy started asking him all these questions about his status here and told him he was going to report his case to INS.. so because he was scared he left the state and moved to Missouri... where he's been living for the last 6 years. I met and married him and we have a baby. We already have an immigration lawyer retained and she's going to get us a criminal lawyer in her network so we can get this matter all straightened out for when we do the paperwork for his green card.My question is.. what is the likelihood that the criminal defense lawyer will be able to keep him from jail time and get his probation transferred here to Missouri?
